It is important to note that information pertaining to employee criminal records is highly confidential and employers do not have the right to access an employee’s criminal data unless the applicant shares it voluntarily.

Spain's Anti Discrimination & Compliance Laws

The legal work week in Spain is 40 hours, and Spain’s Workers Statute states that employers are allowed to distribute the total hours in an irregular fashion throughout the year as long as the arrangement abides by the rules stated in the latest Collective Bargaining Agreement (CBA).

Employers are required by law to pay employees for any overtime hours worked. Paid overtime hours must not exceed 80 hours in a single year by an individual employee, and employers have the option to either compensate their employees for the overtime hours worked, or provide them with additional time off within 4 months of when they last worked overtime hours.

The hiring process in Spain requires that employees provide a written employment contract to all employees. Spanish employees often negotiate for indefinite-term contracts, which grants them with higher job security and typically is accompanied by a higher salary.
