How To Set Up Payroll In Brazil

Before you can begin hiring foreign employees, you are legally required to either set up an entity in Brazil or work with an International PEO. If you elect to do this on your own, you will need to allocate significant time, funds and additional resources to run payroll with full compliance with Brazilian rules and regulations. You will also need to set up a business bank account in Brazil and process all transactions in Brazilian real (BRL).

When setting up your employment contracts with foreign workers in Brazil, be sure to state the official terms for the notice period and any potential severance the employee would be entitled to receive. Brazil’s government tends to favor employees when disputes occur, so it is important to include all relevant information in Portuguese in the employment contract. 

As all employers of Brazilian employees must contribute to a retirement savings fund called the “Fundo de Garantia por Tempo de Serviço,” these funds will be paid out to an employee if he or she is terminated without proper cause. Additionally, the employer is required to pay a fine of 50% of all money paid to the employee over the course of their contract. If the employee is terminated for good cause, the company is not liable to pay these penalties
